Rental Terms and Conditions

1. RESERVATION CONFIRMATION / AGREEMENT

The reservation confirmation is a contract that confirms the rental agreement between the tenant and the landlord. The agreement is binding and applies to the property, its furnishings, and any additional services specified in the confirmation. Only the number of people listed in the reservation may stay overnight at the property.

2. SHORT-TERM RENTAL

Short-term rental / holiday accommodation – Daily/weekly rental prices include electricity, water, internet, and gas. Final cleaning is not included in the rental price.

3. LONG-TERM RENTAL

Long-term rental / duration over 2 months. An additional charge of €20/month for water, €49/month for internet, and electricity and gas are charged based on actual consumption, unless otherwise stated in the agreement that utilities are included in the rent. The final cleaning fee will be added to the rental agreement and is payable with the reservation fee. Rent can be paid in full or in monthly installments. Payment dates will be specified in writing in the agreement.

4. PETS

Pets are only allowed in properties where this is explicitly stated on our website. You must inform us at the time of booking if pets are included. Even in permitted properties, bringing pets is at the renter’s own risk.

5. SMOKING

Smoking is only allowed outdoors, unless otherwise restricted by the property owner (e.g., no smoking on the terrace). Smoking indoors is strictly prohibited. If this rule is violated, the tenant will be responsible for any cleaning costs or damage to furniture or property caused by smoke or odor. The extent of the damage will be determined by the property owner.

6. CLEANING

Properties are rented out clean and in working order, professionally cleaned before your stay. Final cleaning is charged separately (the amount is specified in the reservation confirmation). Tenants must keep the property tidy during their stay and leave it in a reasonably clean condition. Otherwise, special cleaning costs will be deducted from the security deposit or charged separately. Final cleaning does not include dishwashing or trash removal – dishwashing incurs a €30–€50 charge from the deposit. Additional cleaning is charged at €25/hour, plus any laundry costs (e.g. carpets, mattresses, curtains).

7. LIABILITY FOR DAMAGES

The tenant is responsible for any damage, breakage, or loss caused during the rental period. All damages must be reported immediately to the rental agent, including those not caused by the tenant (e.g., water leaks, electrical faults). All issues will be addressed as soon as reasonably possible. If damages are not reported before check-out, repair costs will be deducted from the deposit or charged otherwise. Loistawa Homes S.L. or the property owner is not responsible or insured for the tenant or their belongings.

8. PAYMENT TERMS

Rent and any additional services are paid directly to the property owner’s account. If paying by credit card, the payment will go through Stripe Inc. and will appear on your bank or credit card statement under Loistawa Homes S.L. Other payment terms must be agreed upon in writing. Included utilities are specified in the reservation confirmation. In long-term rentals, electricity is charged according to usage (approx. €0.20–€0.40 / kWh) unless otherwise agreed.

9. RESERVATION / SECURITY DEPOSIT

The reservation becomes valid upon payment of the reservation fee, which also serves as a security deposit.

Short-term rental: The deposit is returned within 14 days after check-out, pending property inspection.

Long-term rental: The deposit is returned within 30 days after the end of the rental period.

⚠️ NOTE: Spanish banks do not show the payer’s account number. To ensure your deposit is returned, please send your account holder name and IBAN to us by email.

Loistawa Homes S.L. may withhold part or all of the deposit if the tenant has neglected property care or cleanliness.

Security deposit / reservation fees:

1-month rental: €250

2-month rental: €500

Over 3 months: 100% of one month’s rent

Villas/townhouses/row houses: €500 unless otherwise agreed.

10. COMPLAINTS

Complaints must be submitted in writing to rent@lainehomes.com, response time is 3–5 business days. If the rental property does not meet expectations, missing equipment or cleaning issues must be reported to Loistawa Homes S.L. immediately after discovery. Failure to report issues means the company is not liable. Construction, roadworks, or maintenance noise, as well as downtime or maintenance in shared facilities (spa, garden, lift, rooftop, pool, play areas, garage, etc.) are not the landlord’s responsibility and do not entitle compensation. Pool renovations or changes in opening hours may not be communicated to the rental agent.

11. CANCELLATIONS

If the reservation is cancelled less than 30 days before the rental period begins, Loistawa Homes S.L. reserves the right to keep the paid reservation/security deposit/service fee. Illness does not entitle a refund – in such cases, please contact your insurance provider. Changing reservation dates is not possible, and early termination of the rental is considered a cancellation. The deposit is not transferable to future bookings. If the booked apartment is unavailable due to reasons beyond Loistawa Homes S.L.’s control, we will offer an equivalent property. If that is not possible, the reservation will be cancelled and the deposit refunded in full.

12. OTHER / PROPERTY RENTAL PRACTICES

We follow international practice: Check-in from 15:00, check-out by 11:00. Other times must be agreed in writing. The property must be returned in the same condition as received. Lost keys incur a €150 charge, and lost pool cards €100. Door opening during the rental costs €50 (08:00–20:00) and €100 outside these hours, plus locksmith fees if needed.

If furniture is moved, it must be returned to its original position. Otherwise, a €30 fee will be charged. Community rules regarding noise, pool use, and shared spaces must be followed. Subletting is prohibited.

13. FORCE MAJEURE

Loistawa Homes S.L. does not compensate for cancellations caused by force majeure.

14. TYPOGRAPHICAL ERRORS

Loistawa Homes S.L. is not responsible for typographical or translation errors in printed or other materials related to the rental.

15. TRADE NAME

Loistawa Homes S.L. operates under the registered trade name Laine Homes and Villas Spain.

16. THIRD-PARTY PLATFORMS

Bookings made via Airbnb, Booking.com, Vrbo, etc., are subject to the terms and conditions of those platforms.

17. PAYMENT SERVICE PROVIDER

Payments are securely processed by Stripe Inc., which ensures safe and efficient transactions. Stripe will appear as the recipient on your bank or credit card statement and will forward the payment to the merchant. For any questions, please contact the website where the payment was made.
